It left pieces of bone and teeth imbedded in his tongue and had to be removed during surgery, Massachusetts General Hospital Dr. Maria Troulis testified, during Sahr Josiah’s Middlesex Superior Court trial yesterday.

Josiah is accused of shooting Hurton on the night of April 14, 2009, sending him to Mass. General with injuries to his face and both hands.

Troulis was the lead doctor on Hurton’s second facial surgery on April 17, 2009.

“We had to make a large neck incision to screw a plate into his jaw to hold it in place,” said Troulis. “There were multiple pieces of bones. We had to put it together like a puzzle.”

The bullet traveled down Hurton’s left cheek and became lodged against his windpipe, or trachea, the surgeon said.

“It was millimeters from being within it,” she said.

The jawbone probably slowed the slug down so it did not pierce the trachea, Troulis said.

However, because the tissue of the trachea is so soft, Troulis said doctors had to remove the bullet because it could have “migrated” into the trachea.

Also yesterday, Emanuel Aguilar testified that it was Josiah, who he knew as “Smoke,” who initiated the robbery of Tommy’s Taxi driver Leon Wilson on Alexander Street that preceded the Hurton shooting.

Aguilar testified under a plea agreement with the Middlesex district attorney’s office. In exchange for his testimony, Aguilar will plead guilty to unarmed robbery and the illegal possession of a firearm.

As part of the plea agreement, he will be sentenced to two and a half years in the Middlesex House of Correction, but will not serve any additional time after being held for nearly two years since his arrest for his role in the robbery. He will also be placed on probation.

Aguilar said he and his friend Kenneth Lacy, who he knew as “K-9,” were walking in downtown Framingham on April 13, 2009, when Josiah started talking to Lacy.

“He was saying he needed somebody to rob,” said Aguilar. “All K-9 said is he got this person named Al he could rob. I said ‘That’s my boy,’ and we couldn’t rob him.”

The next night, Lacy and Aguilar met with Josiah again. Lacy still wanted to rob Al, but Aguilar said he protested. They decided to rob a cab driver.

Before the robbery, Josiah showed the pair he had a handgun. Lacy also showed a gun, but it was a BB gun.

They arranged to have the cab pick them up on Alexander Street because it was a dark area, Aguilar said.
